Here you will find how Run Riot Studio Ltd, trading as Foundation Run (we) collect, use and disclose your information, and how you can correct or change your Personal Information. 

This Privacy Policy should be read in conjunction with our Terms and Conditions.

  1. About our Privacy Policy
    1. Please read this Privacy Policy carefully and ensure you understand it.  By providing information to us and/or using our website, (Website), and our services for coaching (including provision and maintenance of training plans through our athlete dashboard), strength and conditioning, nutrition advice and physiotherapy (Services), you agree to the collection, use and disclosure of your information as set out in this Privacy Policy.
    2. You agree and confirm that you have read and accepted this Privacy Policy.  If you have not read, or if you do not accept, our Privacy Policy, you are not authorised to use our Website or Services or to otherwise deal with us. 
    3. We may update this Privacy Policy from time to time and we encourage you to regularly check the Privacy section on the Website to ensure you are aware of our current Privacy Policy.  You should check from time to time to see if the Privacy Policy has changed.  By continuing to use the Website, you agree to be bound by the amended Privacy Policy. 
  2. Collection of Information
    1. We collect various information about you.  This information includes:
      1. information that personally identifies you such as your name, address, email address, phone number, payment card details, transaction details (Personal Information), being:
        1. Personal Information provided by you:
          1. in the process of setting up a profile on our Website;
          2. making payment through our Website; or
          3. when requesting, using or being provided our Services;
        2. your Personal Information held by third parties (for example Strava and Garmin) that you have authorised to be synced with our Website or that is otherwise publicly available;
        3. personal information provided by you for any other reason, including enquiries you submit;
        4. or other communications you have with us; and
      2. information that does not personally identify you (Non-Personal Information), being:
        1. Non-Personal Information provided by you:
          1. in the process of setting up a profile on our Website;
          2. when requesting, using or being provided our Services;
          3. through authorisation of a sync with a third party (for example Strava and Garmin);
          4. when you are communicating with us;
        2. Non-Personal information obtained from publicly available sources or third parties;
        3. information collected by us through click tracking in relation to your use of the Website, including the content you upload and the content you access;
        4. aggregated data, which tracks traffic to the Website; and
        5. “cookies”, which are pieces of information transferred to your computer hard drive for record keeping (more information about “cookies” is provided further below).

By allowing us to use your information, including Personal Information, we can provide you with the relevant services you require.  Failure to provide, or allow us to obtain, information (including Personal Information) may result in certain functions of the Website or our services not being available to you.
  3. Use of Personal Information
    1. The Personal Information we collect may be used for the following purposes:
      1. provision of Services to you;
      2. verification of your identity;
      3. to answer enquiries you submit;
      4. to facilitate contact between you and third parties, for example gyms, physiotherapists and other medical or health providers, that you authorise and to follow up on your dealings with such third parties;
      5. to request feedback on our Services and any third parties;
      6. to send you information or products we think you may be interested in;
      7. to assist in providing better services to you by tailoring them to meet your needs;
      8. to keep the Website and Services relevant and of interest to users;
      9. to provide further information to you about the Website or other websites we or our related companies (Affiliates) own and services we or our Affiliates provide;
      10. to promote or market special offers related to our Services and industry in general, including services provided by others; and
      11. for any other use that you authorise.
    2. If you authorise your Garmin Health data to be synced with Foundation Run, this data will be used internally to better tailor specific training sessions. You can disconnect the sync at any time within your Garmin Connect profile.
    3. If you do not wish to receive communications from us for any of the purpose described above (excluding clauses 3.1(a) to (c) that are necessary for us to provide the Services) you may unsubscribe from receiving any such communications.
  4. Disclosure of Personal Information
    1. We may disclose your Personal Information to other people where the purposes described above require us to, including to facilitate contact between you and third parties, for example gyms, physiotherapists and other medical or health providers. 
    2. When you deal with third parties facilitated through our Website or Services (for example Strava, Garmin, gyms, physiotherapists and other medical or health providers), you acknowledge you are subject to the privacy policies of any such third party and that we are not responsible for how your information is dealt with by any such third party.
    3. We may also disclose any and all information that we collect from you when we believe release is appropriate to comply with laws or regulations, enforce or apply our Terms and Conditions, or to protect the rights, property, or safety of us, our users, or others or to satisfy legal processes or governmental requests.
  5. Security
    1. We take reasonable steps (consistent with generally accepted industry standards) to protect your Personal Information we hold from unauthorised access, loss or misuse.  However, as no data transmission over the Internet can be guaranteed to be completely secure, we cannot ensure or warrant the security of any information you transmit or receive.  These activities are conducted at your own risk.
  6. Accessing and Updating your Personal Information
    1. You have rights of access to and correction, erasure or restriction of your Personal Information that we hold in an electronic format.  You may request that we do so by contacting our privacy officer, Robert Bathgate, via email: [email protected].  
    2. No fee is required to exercise the rights outlined above in clause 6.1.  However, we may charge a fee if you request is unfounded, repetitive or excessive or we may refuse your request.
  7. Advertising and Links
    1. Our Website may contain links to other sites, which may not follow the same privacy policies as us.  We recommend that you check any relevant privacy policies before providing your personal information to any third party.
    2. You acknowledge that we have no control over the privacy policies of other businesses and you agree it is your responsibility to review such privacy policies prior to submitting any personal details to them.
    3. The Website is linked to various social networking sites.  Your personal information may be accessed and viewed by users of those sites if you submit your information on those sites.  You acknowledge and agree that we are not responsible for protecting your personal information on these sites.
  8. Cookies and Tracking
    1. By accessing the Website, some information may be recorded in a "cookie".
    2. We may use the information generated by "cookies" to:
      1. track traffic patterns to and from the Website including information like the pages you visit, the time you spend on each page, the date and time of your visit, and referring pages (pages you came from or go to);
      2. ensure advertising is being shown to the most appropriate person and limit the frequency of display for certain advertisement formats;
      3. enable you to enter our sites and use certain Services without having to log on each time and to visit restricted areas of the Website; and
      4. identify and maintain certain views and options for user preference.

    1. You acknowledge and agree that we may provide or licence to any third party Non-Personal Information and related rights.  But, subject to clause 10.2, we will not provide or licence to any third party any Personal Information other than in accordance with this Privacy Policy.
  10. Rights to Information
    1. The information we hold about you and the related rights we have in relation to that information (as outlined above) are held by Run Riot Studio Limited.  Run Riot Limited is the controller and is responsible for your Personal Information.
    2. You acknowledge that we may transfer or licence the information (including Personal Information) and related rights to Affiliates or to any third party in the process of sale or part sale our business.
